Terms of Service

These Terms set out the rules for using the Operator's information and marketing websites (crmdlakazdego.pl, mojbni.pl). Data protection is covered by a separate Privacy Policy.
§ 1 General provisions
- These Terms of Service set out the rules for the electronic provision of services within the Operator's information and marketing websites, operated by CRMDLAKAŻDEGO.PL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office at ul. Międzyrzecze Górne 552, 43-392 Międzyrzecze Górne, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) under no. 0000646936, NIP 9372687179, REGON 365857551 (the „Operator").
- These Terms apply to the Operator's information and marketing websites, in particular crmdlakazdego.pl and mojbni.pl, as well as the Operator's further websites of this kind (collectively the „Website").
- The Website serves to present the Operator's offer and to enable contact with potential clients, partners and interested persons. The Website is of an informational and promotional nature.
- These Terms do not govern account registration or licence purchase on the Operator's platform (core.crmdlakazdego.pl) — those matters are governed by a separate Platform regulation and by the General Terms of Agreement (OWU).
- Use of the Website is free of charge.

§ 2 Definitions
- User — any natural person using the Website.
- Operator — CRMdlakazdego.pl Sp. z o.o.
- Website — the Operator's information and marketing websites (incl. crmdlakazdego.pl, mojbni.pl).
- Content — all materials published on the Website: texts, graphics, photos, video, presentations.
- Contact form — the Website functionality enabling a message to be sent to the Operator.
§ 3 Technical requirements for using the Website
- Proper use of the Website requires: a device with Internet access; a modern web browser (Chrome, Firefox, Safari, Edge — current or one previous version); enabled JavaScript and cookies (cookie scope — see § 4).
- The Operator reserves the right to temporary interruptions in the Website's operation in connection with maintenance, updates or failures, and will make efforts to keep such interruptions as short as possible.
§ 4 Cookies, analytics and marketing tools
- The Website uses cookies and similar technologies. By purpose they fall into:
- strictly necessary — required for the proper operation of the Website; do not require the User's consent;
- analytics — used to measure traffic and how the Website is used, including Google Analytics 4 (provider: Google Ireland Ltd.); installed only after consent is given;
- marketing — used to run advertising activities and measure their effectiveness, including Meta Pixel (provider: Meta Platforms Ireland Ltd.); installed only after consent is given.
- Consent to analytics and marketing cookies is voluntary, given via the consent banner displayed on the Website, and may be withdrawn or changed at any time in the banner settings.
- A detailed description of the data controller, the purposes and legal bases of processing, data recipients and the User's rights is provided in the Privacy Policy available on the Website.
§ 5 Rules of using the Website
- The User uses the Website in accordance with applicable law, good practice and these Terms.
- It is prohibited to:
- provide content that is unlawful, offensive or infringing the personal rights of third parties;
- take actions that disrupt the functioning of the Website (e.g. DoS attacks, attempts to gain unauthorised access);
- use the Website for purposes inconsistent with its intended use.
- The Operator may temporarily or permanently prevent the User from using the Website in the event of a gross breach of these Terms or of the law.
§ 6 Contact form
- The User may contact the Operator via the contact form available on the Website or directly by e-mail at biuro@crmdlakazdego.pl.
- Using the form requires providing a name and an e-mail address. Optional fields are phone, company name and message subject.
- Sending the form requires acceptance of these Terms and acknowledgement of the Privacy Policy.
- The Operator makes efforts to respond to enquiries within 1–2 business days.
§ 7 Copyright
- All Content published on the Website (texts, graphics, code, photos, video, presentations) is the property of the Operator or is used under a licence granted to the Operator.
- The marks „CRMdlakazdego", „AD CRM", „Basic CRM", „MFS — My Fit Studio", „MoveMentor", „Move Stream" and related signatures and graphics are protected designations of the Operator.
- Use of Content for any purpose other than permitted personal use (Art. 23 of the Polish Act on Copyright and Related Rights) requires the prior written consent of the Operator.
- Quoting short fragments of Content in the context of review, criticism or analysis is permitted subject to indicating the author (the Operator) and the source (a link to the Website).
§ 8 Operator's liability
- The Operator makes efforts to ensure that the Content published on the Website is current, complete and accurate. However, the Operator is not liable for: temporary unavailability of the Website (hosting failures, maintenance breaks); the actions of third parties (cyberattacks, malware); external content (links to other entities' websites, partners' materials).
- Information published on the Website (including entries in the „News" section, presentations, product descriptions) is of an informational nature and does not constitute an offer within the meaning of Art. 66 § 1 of the Polish Civil Code, unless expressly stated otherwise.
- The Operator is not liable for the consequences of business decisions made by the User on the basis of the Website's Content — the Website serves an informational and promotional function.
§ 9 Complaints
- The User may submit complaints regarding the functioning of the Website to biuro@crmdlakazdego.pl.
- A complaint should include: the name (or company name) of the complainant; a contact e-mail address; a description of the problem; the preferred resolution.
- The Operator processes a complaint within up to 14 business days. The response is provided to the complainant's e-mail address.
§ 10 Out-of-court complaint and redress procedures
- A consumer may use out-of-court complaint handling and redress procedures, including: applying to a permanent amicable consumer court; using the ODR (Online Dispute Resolution) platform: ec.europa.eu/consumers/odr; requesting assistance from the Voivodeship Inspector of the Trade Inspection in resolving the dispute.
§ 11 Changes to the Terms
- The Operator reserves the right to amend these Terms for important reasons, such as changes in the law, changes in the Website's functionality or changes to the Operator's data.
- The Operator informs Users of changes via the Website, at least 7 days before the changes take effect.
- The current version of the Terms is always available on the Website.
§ 12 Final provisions
- The Terms are made available to the User free of charge in a manner allowing their acquisition, reproduction and storage.
- Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act of 18 July 2002 on the provision of services by electronic means, and the Act on Consumer Rights.
- Any disputes arising from the application of these Terms are subject to the jurisdiction of the common courts having local jurisdiction in accordance with the law.
- If any provision of these Terms proves invalid or ineffective, the remaining provisions remain in force.
